Jan 1, 2026 Amendments — Provisions Not Previously Itemised

The amended Act for the Recruitment and Employment of Foreign Professionals (promulgated Sep 24, 2025; effective Jan 1, 2026) includes several provisions not previously summarised in this series:

National Defense — New Field

National defense added as a qualifying field effective Jan 1, 2026. Competent authority and specific assessment criteria are set by the Ministry of National Defense. Details not widely published in English; applicants should confirm eligibility criteria directly with MND before filing.

Foreign Teachers in Experimental Education

Foreign teachers employed in experimental-education institutions (實驗教育) now qualify as a separate eligibility pathway, distinct from the existing K-12 bilingual and university teacher routes activated Jun 30, 2026.

Spouse Open Work Permit — Employer Sponsorship Removed

Gold Card holder spouses can now apply directly for an open work permit — no employer sponsorship required. Permit validity is capped to the holder's dependent-status duration. The holder may work for any employer within that window. This removes the prior constraint requiring a sponsoring employer before a spouse could begin employment legally in Taiwan.

Taiwan Graduate Degree Credit Toward APRC

Years spent completing a degree in Taiwan now count toward the Gold Card APRC residency requirement: PhD = up to 2 years credit; Master's = 1 year credit. Applied retroactively to degrees earned before getting the Gold Card.

183-Day Residency Math Loosened

The amended Act relaxed the rigid 183-day-per-year average calculation that previously caused APRC-clock interruptions for holders with irregular stay patterns. Eligibility — Unchanged

Salary threshold: NTD 160,000/month before-tax; any single tax year within a 3-year lookback. Processing: 30 working days; up to 40 if additional documents requested. No backlog as of Aug 2026. Gold Card standard: 3 years (avg 183 days/year, now with Taiwan-degree credit). NTD 6M+/year income: 1 year (Global Elite Card). Taiwan PhD graduates: 1 year; Master's: 2 years. Top-1,500 global university graduates: exempt from 2-year work experience. Top-200 graduates: open work permit up to 2 years. Digital nomad visa: 2-year maximum (6-month initial + 3 × 6-month renewals; income USD $20K/yr age 20–29, USD $40K/yr age 30+; bank balance USD $10K average over prior 6 months).
